On November 3, 2010, I contacted the IRS regarding the status of my 2009 refund. The IRS informed me that my refund had been sent to an account at the Santa Barbara Bank and Trust (SBB&T). I was taken back, this was my first time hearing of your organization. My federal refund was supposed to be $2,362.54 ,and my state refund $286. I’m due to receive $2,115.54. $500.00 less than anticipated. In turn, I immediately contacted Santa Barabara Bank to inquire about my refund. The SBB&T customer service representative , Ms.Vonceil Isetts was nice enough to explain the situation to me. She informed me that my tax refund was filed using a Refund Anticipation Loan and that $500 had been deducted from my refund to pay the tax preparer. She asked if I had ever signed the loan application. I told her that I did not, and that this was my first time hearing of SBB&T. I had no knowledge of the Refund Anticipation Loan. Ms.Isetts further explained that your bank would send me a check for the $500.00 if proper documentation was received that I paid Mr.Coke ‘s fee for tax preparation.

I forwarded copies of Western Union money transfers ($500.00) showing payment to Mr. Ian Coke for tax preparation. I also sent text messages from Mr.Cook asking me to send the tax preparation fee to Yanique Price.

After receiving no response from the bank, I contacted them and was told the preparer was no longer with their bank and unable to use their services, until the issue is resolved. . I argued that the funds were collected by someone who was not entitled to them and the fact that the preparer never responded or produced any consent/ disclosure form signed by me to process the transaction therefore, the bank should reimburse me for fees and charges that were incurred and the amount stolen from the preparer and go after their former customer.

The bank instructed me to sue the preparer in civil court to recover my funds
